Terms of Service
These Terms are the agreement between you and Mindnull Studio (Berkay ATİK) for the Mistly app. They include a zero-tolerance policy for objectionable content and abusive behaviour (§8), and they explain what you are buying if you subscribe (§4) and what an AI result is and is not (§5). Please read §11 and §12 — they limit our liability.
1. Agreement
By downloading, installing or using Mistly ("the App"), you agree to these Terms of Service ("Terms"), to our Privacy Policy, and to our Community Guidelines, which are incorporated into these Terms by reference. If you do not agree, do not use the App. Apple's standard Licensed Application End User License Agreement also applies; as between you and us these Terms govern, except where Apple's EULA is more restrictive.
2. Age and eligibility
You must be at least 13 years old — or the higher minimum age required in your country (for example 16 in parts of the EEA) — to use the App. If you are under the age of majority where you live, you need your parent or guardian's permission to use the App and to make any purchase. Publishing to the community feed requires an account and is not available to guests.
3. Your account
The App creates an anonymous account on first use; you may optionally link it with Sign in with Apple or Google. You are responsible for activity under your account and for keeping your linked sign-in method secure. You can sign out or permanently delete your account at any time in Settings; deletion removes your Mistly account and the data held against it, and where you used Sign in with Apple, revokes the associated token. Guest accounts can be deleted the same way. A linked account is optional and is not required to purchase, restore or use Premium on the device you bought on.
Deleting your account does not cancel an App Store subscription — cancel that in the App Store. Unused credits from one-time packs are deleted with the account and cannot be restored.
4. Subscriptions, credits and billing
Mistly offers a free tier, optional auto-renewing Premium subscriptions (weekly, monthly and quarterly) and optional one-time consumable credit packs. Current prices, credit amounts and any free-trial offer are shown in the App before you buy, in your local currency.
- Payment is charged to your Apple ID at confirmation of purchase.
- A subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel a subscription in your App Store account settings. We cannot cancel it for you.
- Where a free trial is offered, any unused portion is forfeited when you buy a subscription. Trial eligibility is determined by Apple.
- Credits are a prepaid in-app currency, not money. They have no cash value, cannot be exchanged, transferred or redeemed outside the App, and expire when your account is deleted. Credits are consumed when you run a feature that costs them.
- Premium unlocks Mistly's premium features as described in the App at the time of purchase. Credits are a general in-app currency and are not tied to any one feature.
- Refunds are handled by Apple under App Store policy. We cannot issue App Store refunds. To request one, use reportaproblem.apple.com.
- We may change prices or what a plan includes for future periods. Material changes are announced in the App before they take effect; your remedy is to cancel before the next renewal.
5. AI features — what a result is, and is not
AI Looks are generated by third-party AI models (fal.ai and OpenAI) and are optional. Running one requires the separate consent described in the Privacy Policy, and you can withdraw it at any time in Settings.
- AI output is probabilistic. We do not guarantee that a result will be accurate, faithful, flattering, consistent between runs, or free of artefacts, and a look may not suit every photo.
- A generated image is an edit and an interpretation, not a photographic record. Do not present a result as an unaltered photograph where that would mislead.
- Generation consumes your included allowance or your credits whether or not you like the result. Taste is not a fault, and we do not refund credits for a result you did not like. If a generation fails for a technical reason on our side, the reservation is released.
- Availability depends on third-party providers. Features may be limited, changed or suspended, including for capacity or cost reasons.
- Do not use AI features on images of other people without their consent, on images of minors in any sexualised way, or to create misleading depictions of real people. See §8.
6. Your content
You keep ownership of your photos and of the results you create. We claim no ownership of them.
To operate the App we need a narrow permission: you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit and process your content only as far as necessary to provide the features you use — to send a photo to an AI provider when you run a look, to deliver the result back to you, and to display a post you publish. This licence ends for a given item when you delete it or when it expires. Where you publish to the community feed, the licence also lets us show that post to other users of the App while it exists. We do not use your content for advertising, and we do not use it to train our own AI models.
You are responsible for having the rights to the content you use, including the consent of every identifiable person in it.
7. The community feed ("Explore")
Explore is an optional public feed inside the App. Nothing you create is published unless you publish it, publishing requires a signed-in account, and you may publish at most one post per day. Posts and their comments are deleted automatically 24 hours after publication.
Everything you publish is public to other users of the App. Your posts carry a pseudonymous handle and, if you set one, your profile photo. Do not publish anything you would not want to be public.
8. Zero tolerance for objectionable content and abusive users
We have zero tolerance for objectionable content and for abusive users. By using the App you agree that you will not publish, post, upload as a profile photo, or send in a comment any content that:
- is unlawful, or promotes or facilitates illegal activity;
- sexualises a minor in any way, or depicts a minor in a sexual or suggestive context — this results in an immediate and permanent ban and, where required, a report to the authorities;
- is pornographic or sexually explicit;
- is hateful, harassing, threatening, or attacks a person or group on the basis of race, ethnicity, national origin, religion, disability, disease, age, sex, gender identity or sexual orientation;
- is violent, gory, or glorifies self-harm, suicide or eating disorders;
- depicts or impersonates a real person without their consent, including deceptive "deepfakes";
- infringes anyone's intellectual property, privacy or publicity rights;
- is spam, a scam, or promotes drugs, alcohol, weapons, gambling or tobacco;
- contains anyone's personal information, including your own.
You also agree not to harass, threaten, stalk or abuse other users, and not to evade a restriction placed on your account.
By publishing you confirm that you hold all necessary rights to the image, including the consent of every identifiable person in it, and that publishing it breaks no law and no one else's rights.
The Community Guidelines set out the rules in full and are part of these Terms.
9. Moderation and enforcement
We take the following steps, and you agree to use them where relevant:
- Automatic filtering. Every image is screened automatically before it becomes public. Content that fails screening is refused and never published.
- Reporting. Every post and every comment can be reported from the App, with a reason. We act on reports of objectionable content within 24 hours — removing the content, and ejecting the user who provided it where appropriate. Content that reaches the report threshold is hidden immediately and automatically, without waiting for review.
- Blocking. You can block another user from the App; their content then stops reaching you.
- Deletion. You can delete your own post or comment at any time. The owner of a post can delete any comment on it.
- Strikes and bans. An account whose content is removed twice permanently loses the ability to publish. Serious violations are banned on the first offence.
We may remove content, restrict publishing, or suspend or terminate an account, with or without notice, where we reasonably believe these Terms or the Community Guidelines have been broken, or where required by law. To report content or appeal a decision, write to support@mindnullstudio.com.
10. Acceptable use of the App
Do not reverse engineer, decompile or tamper with the App; do not attempt to bypass usage limits, App Check, authentication, screening or payment; do not access the service by automated means, resell it, or use it to build a competing service; do not overload or disrupt the infrastructure. We may limit or suspend access to protect the service and the people using it.
11. Intellectual property
The App, its name, its interface, its look catalogue, its prompts, its artwork and its code are owned by Mindnull Studio and protected by law. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, as permitted by the App Store Terms of Service. Nothing here transfers ownership. Feedback you send us may be used freely and without obligation.
12. Third-party services
The App relies on Google Firebase and Google Cloud, Google Cloud Vision, fal.ai, OpenAI, RevenueCat and Apple. Their processing is governed by their own terms and privacy policies, listed in our Privacy Policy. We are not responsible for third-party services, and their availability may affect ours.
13. Disclaimer of warranties
To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, Mindnull Studio is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill, or content — including content lost because a device failed, an app was deleted, or a post expired. Our total liability for any claim relating to the App is limited to the greater of the amount you paid us for the App in the 12 months before the claim, or 10 USD. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Your statutory consumer rights are unaffected.
15. Indemnification
You agree to indemnify and hold harmless Mindnull Studio from claims, damages, losses and reasonable legal costs arising from content you publish, your use of the App, or your breach of these Terms or of anyone's rights.
16. Termination
You may stop using the App at any time and delete your account in Settings. We may suspend or terminate access if you break these Terms or the Community Guidelines, or where required by law. Sections that by their nature should survive termination — content licences already exercised, intellectual property, disclaimers, limitation of liability, indemnification and governing law — survive it.
17. Apple App Store
- These Terms are between you and Mindnull Studio only, not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claim relating to the App, including product liability, legal or regulatory non-compliance, or consumer protection claims.
- If a third party claims the App infringes their intellectual property, Mindnull Studio, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Changes to these Terms
We may update these Terms. The date at the top changes, and for a material change we tell you in the App before it takes effect. Continuing to use Mistly after a change means you accept it.
19. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules, except where mandatory consumer-protection law in your country of residence gives you additional protection. Claims may be brought only on an individual basis, not as a class action. Disputes go to the competent courts of Türkiye, without prejudice to any mandatory right you have to bring proceedings in your country of residence.
20. Severability and entire agreement
If a provision is unenforceable, the rest stays in effect. These Terms, the Privacy Policy, the Community Guidelines and Apple's EULA are the entire agreement between us and supersede any prior agreement. Not enforcing a provision is not a waiver of it.

Kullanım Koşulları
Bu Koşullar, Mistly uygulaması için sizinle Mindnull Studio (Berkay ATİK) arasındaki sözleşmedir. Sakıncalı içerik ve kötü niyetli kullanıcılara karşı sıfır tolerans politikamızı (§8) içerir; abone olursanız ne satın aldığınızı (§4) ve bir yapay zekâ sonucunun ne olup ne olmadığını (§5) açıklar. Lütfen sorumluluğumuzu sınırlayan §11 ve §12'yi okuyun.
1. Sözleşme
Mistly'yi ("Uygulama") indirerek, kurarak veya kullanarak bu Kullanım Koşulları'nı ("Koşullar"), Gizlilik Politikası'nı ve atıfla bu Koşullar'ın parçası hâline gelen Topluluk Kuralları'nı kabul edersiniz. Kabul etmiyorsanız Uygulama'yı kullanmayın. Apple'ın standart Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi de geçerlidir; sizinle bizim aramızda, Apple'ın sözleşmesi daha kısıtlayıcı olmadıkça bu Koşullar uygulanır.
2. Yaş ve uygunluk
Uygulama'yı kullanmak için en az 13 yaşında — veya ülkenizde gereken daha yüksek asgari yaşta (örneğin AEA'nın bazı bölgelerinde 16) — olmalısınız. Yaşadığınız yerde reşit değilseniz, Uygulama'yı kullanmak ve satın alma yapmak için ebeveyn veya vasinizin izni gerekir. Topluluk akışında paylaşım yapmak hesap gerektirir ve misafirlere açık değildir.
3. Hesabınız
Uygulama ilk kullanımda anonim bir hesap oluşturur; dilerseniz Apple ile Giriş veya Google ile bağlayabilirsiniz. Hesabınız altındaki faaliyetlerden ve bağlı giriş yönteminizin güvenliğinden siz sorumlusunuz. Ayarlar'dan istediğiniz zaman çıkış yapabilir veya hesabınızı kalıcı olarak silebilirsiniz; silme, Mistly hesabınızı ve ona bağlı tutulan verileri kaldırır, Apple ile Giriş kullandıysanız ilgili belirteci iptal eder. Misafir hesapları da aynı şekilde silinebilir. Bağlı hesap isteğe bağlıdır; satın aldığınız cihazda satın almak, geri yüklemek veya Premium kullanmak için gerekmez.
Hesabınızı silmek App Store aboneliğinizi iptal etmez — onu App Store'dan iptal edin. Tek seferlik paketlerden kalan kullanılmamış krediler hesapla birlikte silinir ve geri yüklenemez.
4. Abonelikler, krediler ve faturalandırma
Mistly'de ücretsiz bir kademe, isteğe bağlı otomatik yenilenen Premium abonelikler (haftalık, aylık, üç aylık) ve isteğe bağlı tek seferlik kredi paketleri bulunur. Güncel fiyatlar, kredi miktarları ve varsa ücretsiz deneme teklifi, satın almadan önce Uygulama içinde yerel para biriminizle gösterilir.
- Ödeme, satın alma onayında Apple Kimliğinize yansıtılır.
- Abonelik, mevcut dönemin bitiminden en az 24 saat önce otomatik yenileme kapatılmadıkça kendiliğinden yenilenir. Yenileme ücreti dönem bitiminden önceki 24 saat içinde tahsil edilir.
- Aboneliğinizi App Store hesap ayarlarınızdan yönetebilir veya iptal edebilirsiniz. Sizin adınıza iptal edemeyiz.
- Ücretsiz deneme sunulduğunda, bir abonelik satın aldığınızda denemenin kullanılmayan kısmı sona erer. Deneme uygunluğunu Apple belirler.
- Krediler ön ödemeli bir uygulama içi birimdir, para değildir. Nakit değeri yoktur; Uygulama dışında değiştirilemez, devredilemez ve paraya çevrilemez; hesabınız silindiğinde sona erer. Krediler, kredi gerektiren bir özelliği çalıştırdığınızda harcanır.
- Premium, satın alma anında Uygulama'da anlatılan premium özellikleri açar. Krediler genel bir uygulama içi birimdir ve tek bir özelliğe bağlı değildir.
- İadeler App Store politikası uyarınca Apple tarafından yürütülür. App Store iadesi veremeyiz. Talep için reportaproblem.apple.com adresini kullanın.
- Fiyatları veya bir planın kapsamını gelecek dönemler için değiştirebiliriz. Esaslı değişiklikler yürürlüğe girmeden önce Uygulama'da duyurulur; hakkınız, bir sonraki yenilemeden önce iptal etmektir.
5. Yapay zekâ özellikleri — sonuç nedir, ne değildir
AI Looks, üçüncü taraf yapay zekâ modelleri (fal.ai ve OpenAI) tarafından üretilir ve isteğe bağlıdır. Çalıştırmak, Gizlilik Politikası'nda anlatılan ayrı onayı gerektirir; bu onayı istediğiniz zaman Ayarlar'dan geri alabilirsiniz.
- Yapay zekâ çıktısı olasılıksaldır. Sonucun doğru, aslına sadık, hoşunuza gidecek, denemeler arasında tutarlı veya kusursuz olacağını garanti etmeyiz; bir look her fotoğrafa uymayabilir.
- Üretilen görsel bir düzenleme ve yorumdur, fotoğrafik bir kayıt değildir. Yanıltıcı olacak bir bağlamda sonucu değiştirilmemiş bir fotoğraf gibi sunmayın.
- Üretim, sonucu beğenseniz de beğenmeseniz de dahil hakkınızı veya kredilerinizi harcar. Beğeni bir kusur değildir; beğenmediğiniz bir sonuç için kredi iadesi yapmayız. Bir üretim bizim tarafımızdaki teknik bir nedenle başarısız olursa ayrılan hak serbest bırakılır.
- Erişilebilirlik üçüncü taraf sağlayıcılara bağlıdır. Özellikler kapasite veya maliyet dâhil nedenlerle sınırlanabilir, değiştirilebilir veya askıya alınabilir.
- Yapay zekâ özelliklerini başkalarının görselleri üzerinde onayları olmadan, reşit olmayanların görselleri üzerinde cinsel içerikli hiçbir biçimde ve gerçek kişilere dair yanıltıcı tasvirler üretmek için kullanmayın. Bkz. §8.
6. İçeriğiniz
Fotoğraflarınızın ve ürettiğiniz sonuçların mülkiyeti sizde kalır. Bunlar üzerinde hiçbir mülkiyet iddiamız yoktur.
Uygulama'yı işletmek için dar kapsamlı bir izne ihtiyacımız var: içeriğinizi yalnızca kullandığınız özellikleri sunmak için gerekli olduğu ölçüde barındırmak, saklamak, çoğaltmak, iletmek ve işlemek üzere bize dünya çapında, münhasır olmayan, telifsiz bir lisans verirsiniz — bir look çalıştırdığınızda fotoğrafı sağlayıcıya göndermek, sonucu size teslim etmek ve paylaştığınız bir gönderiyi göstermek için. Bu lisans, ilgili içeriği sildiğinizde veya süresi dolduğunda sona erer. Topluluk akışında paylaştığınızda lisans, gönderi var olduğu sürece onu Uygulama'nın diğer kullanıcılarına göstermemizi de kapsar. İçeriğinizi reklam için kullanmayız ve kendi yapay zekâ modellerimizi eğitmek için kullanmayız.
Kullandığınız içeriğe ilişkin haklara — içindeki tanınabilir her kişinin onayı dâhil — sahip olmaktan siz sorumlusunuz.
7. Topluluk akışı ("Explore")
Explore, Uygulama içindeki isteğe bağlı ve herkese açık bir akıştır. Siz paylaşmadıkça ürettiğiniz hiçbir şey yayımlanmaz, paylaşım giriş yapmış bir hesap gerektirir ve günde en fazla bir gönderi paylaşabilirsiniz. Gönderiler ve yorumları yayımlanmalarından 24 saat sonra otomatik olarak silinir.
Paylaştığınız her şey Uygulama'nın diğer kullanıcılarına açıktır. Gönderileriniz takma bir kullanıcı adı ve belirlediyseniz profil fotoğrafınızla görünür. Herkese açık olmasını istemeyeceğiniz hiçbir şeyi paylaşmayın.
8. Sakıncalı içerik ve kötü niyetli kullanıcılara sıfır tolerans
Sakıncalı içeriğe ve kötü niyetli kullanıcılara sıfır toleransımız vardır. Uygulama'yı kullanarak; aşağıdaki nitelikteki hiçbir içeriği yayımlamayacağınızı, profil fotoğrafı olarak yüklemeyeceğinizi veya yorum olarak göndermeyeceğinizi kabul edersiniz:
- hukuka aykırı olan ya da yasa dışı faaliyeti teşvik eden veya kolaylaştıran;
- reşit olmayan bir kişiyi herhangi bir biçimde cinselleştiren veya cinsel ya da müstehcen bir bağlamda gösteren — bu, derhal ve kalıcı yasaklama ve gerektiğinde yetkili makamlara bildirim ile sonuçlanır;
- pornografik veya müstehcen olan;
- nefret içeren, taciz eden, tehdit eden veya bir kişiye ya da gruba ırk, etnik köken, milliyet, din, engellilik, hastalık, yaş, cinsiyet, cinsiyet kimliği veya cinsel yönelim temelinde saldıran;
- şiddet içeren, kanlı olan ya da kendine zarar vermeyi, intiharı veya yeme bozukluklarını yücelten;
- gerçek bir kişiyi onayı olmadan tasvir eden veya taklit eden, aldatıcı "deepfake"ler dâhil;
- başkasının fikri mülkiyet, özel hayat veya kişilik haklarını ihlal eden;
- istenmeyen içerik, dolandırıcılık olan ya da uyuşturucu, alkol, silah, kumar veya tütün tanıtan;
- kendinizinki dâhil, herhangi birinin kişisel bilgisini içeren.
Ayrıca diğer kullanıcıları taciz etmemeyi, tehdit etmemeyi, takip etmemeyi ve hesabınıza konulan bir kısıtlamayı aşmaya çalışmamayı kabul edersiniz.
Paylaşarak, görsele ilişkin gerekli tüm haklara — içindeki tanınabilir her kişinin onayı dâhil — sahip olduğunuzu ve paylaşımın hiçbir yasayı ve hiç kimsenin hakkını ihlal etmediğini beyan edersiniz.
Kuralların tamamı Topluluk Kuralları'nda yer alır ve bu Koşullar'ın parçasıdır.
9. Denetim ve yaptırım
Aşağıdaki adımları uygularız; ilgili olduğu yerde bunları kullanmayı kabul edersiniz:
- Otomatik filtreleme. Her görsel, herkese açık hâle gelmeden önce otomatik olarak denetlenir. Denetimden geçemeyen içerik reddedilir ve hiç yayımlanmaz.
- Bildirim. Her gönderi ve her yorum, bir sebep seçilerek Uygulama'dan bildirilebilir. Sakıncalı içerik bildirimlerine 24 saat içinde işlem yaparız — içeriği kaldırır, uygun olduğunda içeriği sağlayan kullanıcıyı hizmetten çıkarırız. Bildirim eşiğine ulaşan içerik, inceleme beklenmeden derhal ve otomatik olarak gizlenir.
- Engelleme. Uygulama'dan başka bir kullanıcıyı engelleyebilirsiniz; içeriği artık size ulaşmaz.
- Silme. Kendi gönderinizi veya yorumunuzu istediğiniz zaman silebilirsiniz. Bir gönderinin sahibi, gönderisindeki her yorumu silebilir.
- İhlal puanı ve yasaklama. İçeriği iki kez kaldırılan hesap, paylaşım yapma yetkisini kalıcı olarak kaybeder. Ağır ihlaller ilk seferde yasaklanır.
Bu Koşullar'ın veya Topluluk Kuralları'nın ihlal edildiğine makul olarak kanaat getirdiğimizde ya da hukuken gerekli olduğunda; bildirimli veya bildirimsiz olarak içeriği kaldırabilir, paylaşımı kısıtlayabilir, hesabı askıya alabilir veya sonlandırabiliriz. İçerik bildirmek veya bir karara itiraz etmek için support@mindnullstudio.com adresine yazın.
10. Uygulamanın kabul edilebilir kullanımı
Uygulama'yı tersine mühendislikle çözmeyin, kaynak koda dönüştürmeyin ve kurcalamayın; kullanım sınırlarını, App Check'i, kimlik doğrulamayı, denetimi veya ödemeyi aşmaya çalışmayın; hizmete otomatik araçlarla erişmeyin, yeniden satmayın ve rakip bir hizmet kurmak için kullanmayın; altyapıyı aşırı yüklemeyin ve aksatmayın. Hizmeti ve kullananları korumak için erişimi sınırlayabilir veya askıya alabiliriz.
11. Fikri mülkiyet
Uygulama; adı, arayüzü, look kataloğu, komutları, görselleri ve kodu Mindnull Studio'ya aittir ve hukuken korunur. Bu Koşullar size, App Store Hizmet Koşulları'nın izin verdiği ölçüde, sahip olduğunuz veya kontrol ettiğiniz Apple cihazlarında Uygulama'yı kullanmanız için sınırlı, kişisel, münhasır olmayan, devredilemez ve geri alınabilir bir lisans verir. Burada hiçbir mülkiyet devri yoktur. Bize ilettiğiniz geri bildirimler serbestçe ve yükümlülük doğurmaksızın kullanılabilir.
12. Üçüncü taraf hizmetleri
Uygulama; Google Firebase ve Google Cloud, Google Cloud Vision, fal.ai, OpenAI, RevenueCat ve Apple'a dayanır. Bunların işleme faaliyetleri, Gizlilik Politikası'nda listelenen kendi koşul ve gizlilik politikalarına tabidir. Üçüncü taraf hizmetlerinden sorumlu değiliz; erişilebilirlikleri bizimkini etkileyebilir.
13. Garanti reddi
Yasaların izin verdiği azami ölçüde Uygulama "olduğu gibi" ve "mevcut hâliyle" sunulur; ticari elverişlilik, belirli bir amaca uygunluk, ihlal etmeme, doğruluk ya da kesintisiz veya hatasız çalışma dâhil olmak üzere açık veya zımni hiçbir garanti verilmez. 14. Sorumluluğun sınırlandırılması
Yasaların izin verdiği azami ölçüde Mindnull Studio; dolaylı, arızi, özel, sonuç niteliğinde veya cezai zararlardan ya da kâr, veri, itibar veya içerik kaybından — cihaz arızası, uygulamanın silinmesi ya da bir gönderinin süresinin dolması nedeniyle kaybedilen içerik dâhil — sorumlu değildir. Uygulama'ya ilişkin herhangi bir talepteki toplam sorumluluğumuz, talepten önceki 12 ay içinde Uygulama için bize ödediğiniz tutar ile 10 ABD doları'ndan yüksek olanıyla sınırlıdır. Burada hiçbir hüküm, ihmal sonucu ölüm veya bedensel zarar ile hile dâhil olmak üzere hukuken hariç tutulamayacak sorumluluğu bertaraf etmez. Tüketici olarak yasal haklarınız saklıdır.
15. Tazminat
Yayımladığınız içerikten, Uygulama'yı kullanımınızdan ya da bu Koşullar'ı veya herhangi birinin haklarını ihlal etmenizden doğan talep, zarar, kayıp ve makul hukuki masraflara karşı Mindnull Studio'yu tazmin etmeyi ve zarardan âri kılmayı kabul edersiniz.
16. Fesih
Uygulama'yı kullanmayı istediğiniz zaman bırakabilir ve hesabınızı Ayarlar'dan silebilirsiniz. Bu Koşullar'ı veya Topluluk Kuralları'nı ihlal etmeniz hâlinde ya da hukuken gerekli olduğunda erişimi askıya alabilir veya sonlandırabiliriz. Niteliği gereği fesihten sonra da geçerli kalması gereken hükümler — kullanılmış içerik lisansları, fikri mülkiyet, garanti reddi, sorumluluk sınırı, tazminat ve uygulanacak hukuk — yürürlükte kalır.
17. Apple App Store
- Bu Koşullar yalnızca sizinle Mindnull Studio arasındadır, Apple ile değildir. Apple, Uygulama'dan veya içeriğinden sorumlu değildir.
- Apple'ın Uygulama için bakım veya destek sağlama yükümlülüğü yoktur.
- Uygulama geçerli bir garantiye uymazsa Apple'a bildirebilirsiniz; Apple satın alma bedelini iade eder. Yasaların izin verdiği azami ölçüde Apple'ın başka bir garanti yükümlülüğü yoktur.
- Ürün sorumluluğu, mevzuata uygunsuzluk veya tüketicinin korunması talepleri dâhil, Uygulama'ya ilişkin taleplerin karşılanmasından Apple sorumlu değildir.
- Üçüncü bir taraf Uygulama'nın fikri mülkiyetini ihlal ettiğini iddia ederse; bu talebin soruşturulması, savunulması, sulhu ve ifasından Apple değil Mindnull Studio sorumludur.
- ABD hükûmetinin ambargo uyguladığı veya "terörizmi destekleyen" olarak nitelendirdiği bir ülkede bulunmadığınızı ve ABD hükûmetinin yasaklı veya kısıtlı taraflar listelerinde yer almadığınızı beyan edersiniz.
- Apple ve bağlı şirketleri bu Koşullar'ın üçüncü taraf lehtarlarıdır ve Koşullar'ı size karşı uygulayabilir.
18. Koşullardaki değişiklikler
Bu Koşullar'ı güncelleyebiliriz. Üstteki tarih değişir; esaslı bir değişiklikte yürürlüğe girmeden önce Uygulama içinde bildiririz. Değişiklikten sonra Mistly'yi kullanmaya devam etmeniz kabul anlamına gelir.
19. Uygulanacak hukuk ve uyuşmazlıklar
Bu Koşullar, kanunlar ihtilafı kurallarına bakılmaksızın Türkiye Cumhuriyeti hukukuna tabidir; ikamet ettiğiniz ülkenin emredici tüketici koruma mevzuatının size sağladığı ek korumalar saklıdır. Talepler yalnızca bireysel olarak ileri sürülebilir, toplu dava biçiminde değil. Uyuşmazlıklar Türkiye'deki yetkili mahkemelerde görülür; ikamet ettiğiniz ülkede dava açmaya ilişkin emredici haklarınız saklıdır.
20. Bölünebilirlik ve bütünlük
Bir hüküm uygulanamaz hâle gelirse geri kalanı yürürlükte kalır. Bu Koşullar, Gizlilik Politikası, Topluluk Kuralları ve Apple'ın lisans sözleşmesi aramızdaki sözleşmenin bütününü oluşturur ve önceki anlaşmaların yerine geçer. Bir hükmü uygulamamak, o hükümden feragat anlamına gelmez.
